These Terms and Conditions (“Terms”) govern your access to and use of the MakeOurHome mobile application, website, and related products, features, and services (collectively, the “Services”).
The Services are provided by MakeOurHome Inc., doing business as MakeOurHome (“MakeOurHome,” “we,” “us,” or “our”).
Please read these Terms carefully. By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy.
You must be at least 18 years old to use MakeOurHome.
If you do not agree to these Terms, you may not access or use the Services.
You must be at least 18 years of age to create an account or use the Services.
By creating an account or using MakeOurHome, you represent and warrant that:
• You are at least 18 years old;
• You have the legal capacity to enter into these Terms; and
• Your use of the Services will comply with these Terms and all applicable laws and regulations.
MakeOurHome is not intended for individuals under the age of 18.
MakeOurHome provides technology designed to help users scan, visualize, organize, understand, and interact with information relating to their homes and properties.
Depending on the features available to you, the Services may allow you to:
• Scan rooms or areas of a property;
• Create digital representations or 3D models of a home;
• Generate floor plans, measurements, spatial information, reports, or other property-related information;
• Store and organize information about rooms, furniture, fixtures, appliances, and other items;
• Receive home-related insights, recommendations, or information;
• Share certain property, room, scan, model, or report information with others; and
• Access additional home-related tools and features that MakeOurHome may introduce from time to time.
Features may change, be added, or be removed as the Services evolve.
Certain features require you to create an account.
When creating an account, you agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for:
• Maintaining the confidentiality of your login credentials;
• All activity occurring through your account; and
• Promptly notifying us if you suspect unauthorized access to or use of your account.
You may not create an account using false information, impersonate another person, or allow another person to use your account in violation of these Terms.
We reserve the right to suspend or terminate accounts that contain inaccurate information, are being used fraudulently, or otherwise violate these Terms.
You may only use MakeOurHome to scan, photograph, record, model, or otherwise collect information about a property when you have the legal right or appropriate permission to do so.
By scanning or submitting information about a property, you represent and warrant that you:
• Own, occupy, manage, or otherwise have appropriate permission to access the property;
• Have permission to capture the applicable rooms, spaces, objects, and other property information; and
• Will not use MakeOurHome to unlawfully invade another person’s privacy or collect information without appropriate authorization.
You are solely responsible for obtaining any permissions necessary before scanning or submitting information concerning a property.
Certain features may require access to your device’s camera, location, sensors, photo library, or other device functionality.
When required, MakeOurHome will request permission before accessing these features.
You may manage permissions through your device settings. However, disabling certain permissions may prevent some MakeOurHome features from functioning properly.
Our collection and use of information obtained through these permissions is described in our Privacy Policy.
MakeOurHome may generate measurements, room layouts, floor plans, spatial reports, 3D models, property information, recommendations, or other outputs based on information collected through your device or provided by you.
These outputs are provided for informational and general-use purposes only.
Measurements, dimensions, layouts, scans, models, reports, and other outputs may contain inaccuracies or may differ from actual physical conditions.
You should independently verify information before relying on MakeOurHome for decisions involving construction, renovation, architecture, engineering, real estate transactions, property valuation, safety, legal compliance, or other professional purposes.
MakeOurHome is not a substitute for a licensed architect, engineer, surveyor, contractor, inspector, appraiser, real estate professional, or other qualified professional.
MakeOurHome may provide recommendations, insights, scores, analyses, suggestions, or other information relating to your home.
These features are intended to provide general information and assist users in exploring and understanding their homes.
Unless expressly stated otherwise, such information should not be considered professional architectural, engineering, financial, real estate, legal, health, safety, or other professional advice.
You are responsible for evaluating whether any recommendation or information is appropriate for your circumstances.
“User Content” means information or content you upload, submit, capture, create, or otherwise provide through the Services, including photographs, scans, property information, room information, text, images, and other materials.
You retain ownership of your User Content, subject to the rights you grant to us under these Terms.
By submitting User Content, you grant MakeOurHome a limited, non-exclusive, worldwide license to host, store, reproduce, process, modify, and otherwise use your User Content as reasonably necessary to operate, provide, maintain, secure, and improve the Services.
This license does not transfer ownership of your User Content to MakeOurHome.
You represent and warrant that you have all rights and permissions necessary to provide your User Content and permit MakeOurHome to process it as described in these Terms and our Privacy Policy.
You agree not to misuse the Services.
You may not:
• Use the Services for unlawful, fraudulent, deceptive, or harmful purposes;
• Scan or collect information about a property without appropriate permission;
• Violate another person’s privacy or intellectual property rights;
• Upload malicious code, viruses, or other harmful material;
• Attempt to gain unauthorized access to MakeOurHome’s systems, accounts, networks, or data;
• Circumvent security measures or access restrictions;
• Interfere with or disrupt the operation of the Services;
• Use automated systems, bots, scrapers, or similar technology to access the Services without our authorization;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services except where such restrictions are prohibited by applicable law;
• Copy, reproduce, distribute, sell, sublicense, or commercially exploit the Services without our permission; or
• Use the Services in any manner that violates applicable law or these Terms.
Except for User Content, the Services and all associated technology, software, designs, graphics, logos, trademarks, text, interfaces, features, models, and other materials are owned by or licensed to MakeOurHome and are protected by applicable intellectual property laws.
Subject to these Terms, MakeOurHome grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purposes.
No ownership rights in MakeOurHome’s intellectual property are transferred to you.
If you provide ideas, suggestions, recommendations, or other feedback regarding MakeOurHome or the Services, you agree that we may use that feedback without restriction or compensation to you.
Providing feedback does not give you any ownership interest in changes, improvements, or features we develop based on that feedback.
MakeOurHome may contain integrations with, links to, or functionality provided by third-party services.
Your use of third-party services may be governed by separate terms and privacy policies established by those third parties.
We do not control and are not responsible for third-party services, their availability, their content, or their practices.
Certain MakeOurHome features may require payment or a subscription.
If paid features are offered, applicable pricing, subscription periods, and payment terms will be presented to you before purchase.
If you purchase a subscription through the Apple App Store, Google Play, or another third-party platform, your payment, renewal, cancellation, and refund rights may also be governed by that platform’s applicable terms.
Unless otherwise stated, subscriptions may automatically renew until canceled in accordance with the terms presented at the time of purchase.
MakeOurHome may change its pricing or introduce new paid features in the future, subject to applicable law and any required notice.
Your privacy is important to us.
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use MakeOurHome.
By using the Services, you acknowledge that you have reviewed our Privacy Policy.
We work to provide reliable Services, but we do not guarantee that MakeOurHome will always be available, uninterrupted, secure, or error-free.
We may periodically:
• Add or remove features;
• Modify functionality;
• Perform maintenance;
• Release updates;
• Restrict access to certain features; or
• Discontinue all or part of the Services.
Where required by applicable law, we will provide appropriate notice of material changes.
You may stop using MakeOurHome at any time.
You may request deletion of your account through any account deletion functionality made available within the Services or by contacting us at [email protected].
We may suspend, restrict, or terminate your access to the Services if we reasonably believe that you:
• Violated these Terms;
• Used the Services unlawfully or fraudulently;
• Created a security or safety risk;
• Infringed the rights of another person; or
• Engaged in conduct that could harm MakeOurHome, our users, or others.
Where appropriate and required by law, we may provide notice before taking such action.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
MAKEOURHOME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT ANY SCANS, MEASUREMENTS, MODELS, REPORTS, RECOMMENDATIONS, OR OTHER OUTPUTS WILL BE COMPLETE OR ACCURATE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKEOURHOME AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM RELIANCE ON MEASUREMENTS, SCANS, FLOOR PLANS, SPATIAL DATA, 3D MODELS, REPORTS, RECOMMENDATIONS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEOURHOME’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MAKEOURHOME DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
Some jurisdictions do not permit certain limitations of liability, so these limitations may not apply to you in their entirety.
To the extent permitted by applicable law, you agree to indemnify and hold harmless MakeOurHome and its affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
• Your violation of these Terms;
• Your misuse of the Services;
• Your User Content;
• Your violation of another person’s rights; or
• Your scanning or submission of information about a property without appropriate authorization.
These Terms will be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Any disputes not subject to arbitration will be brought in the state or federal courts located in [County, State], unless applicable law provides you with the right to bring a claim elsewhere.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration, rather than in court, except that either party may bring an eligible claim in small claims court.
You and MakeOurHome agree that disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action, to the extent permitted by applicable law.
Nothing in this section prevents either party from seeking appropriate injunctive or equitable relief where permitted by law.
Additional arbitration procedures, the arbitration provider, applicable rules, opt-out procedures, and required notices should be specified before this provision is implemented.
We may update these Terms from time to time to reflect changes to the Services, our business practices, or applicable law.
When we update these Terms, we will revise the “Last Updated” date above.
If we make material changes, we may provide additional notice through the Services, by email, or through another appropriate method.
Where required by law, we will obtain your consent to updated Terms.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and any additional terms presented to you for specific features or services, constitute the entire agreement between you and MakeOurHome regarding your use of the Services.
